Election of Revenue Ruling 70-604 passed with an overwhelming majority. Please read below for explanation. Ruling 70-604 Excess Income Applied to the Following year’s Assessments is a ruling that requires a vote of the membership at an Annual Meeting. The Ruling, if adopted, allows the Board to designate “surplus operating funds in a given budget year to be designated in some capacity to offset the following year’s increase in assessments. (Possibilities are Contingency Reserve, Capital Reserve or Offset future Operating Expenses). Formal Adoption of this ruling must be made every year. Adoption of this Resolution enables the Board to “officially” designate those surplus funds so as to comply with tax laws that allow the Board to choose to file the Association’s taxes under form 1120H (Not for Profit – currently used) or to choose to file 1120 (Corporate). The benefit to having this option is that if surplus funds are designated for use in the coming calendar budget and the Association can “net zero” on revenue, then the tax required on “interest income” (from Capital Reserve Investments) will be taxed as little as 15% as opposed to the 30%(that is currently taxed under the 1120 H (Not for Profit) filing. 2012 Board of Directors: To see the results of your new 2012 Board of Directors please click here. He is an officer in our homeowners association and he now has the special tool needed to turn off your water where it connects to the main city line until a plumber can make the necessary repair.
